FULL TERMS, CONDITIONS & SALE‑DAY POLICIES

SALE ANNOUNCEMENT

All announcements made by Miller Auto Auction staff on sale day take precedence over all printed material, online listings, or prior advertising.

PAYMENT TERMS

All purchases must be paid in full on sale day.

 

Accepted payment methods:

  • Cash

  • Cashier’s Check

  • Company or Personal Check

  • Credit/Debit Cards (Visa, MasterCard, Discover, American Express) — 4% convenience fee applies

 

Checks not accompanied by a bank letter or not personally known by Miller Auto Auction will be denied.

 

All checks must be made payable to Miller Auto Auction.

TENNESSEE SALES TAX

  • Items $3,200 and under are taxed at 9.75%.

  • Items over $3,200 are taxed at 7% after the first $3,200, which is taxed at 9.75%.

Exemptions:

  • Farmers must provide a valid Tennessee Agricultural Exemption Certificate.

  • Dealers must provide a valid Certificate of Resale on sale day.

  • Auto dealers must provide a copy of their Tennessee Auto Dealer License and Certificate of Resale.

BIDDING RULES

  • In the event of a tie bid, the auctioneer reserves the right to reopen bidding.

  • The auctioneer may revoke any bidder badge at any time.

  • Anyone bidding for an account other than their own must obtain a separate bidder number for that account.

  • The high bid accepted by the auctioneer is a binding verbal contract. Bids may not be retracted, and buyers are not entitled to adjustments, allowances, rescission, or damages regarding the condition of any item purchased.

BUYER DEPOSIT REQUIREMENT

All public buyers must place a $200 deposit to receive a bidder badge.

 

This deposit is not a spending limit. It is held until checkout and applied toward the buyer’s fee.

  • If the buyer’s fee is less than $200, the unused portion is refunded.

  • If the buyer’s fee is $200 or more, the deposit is fully applied.

  • If no vehicle is purchased, the full $200 deposit is refunded when the bidder badge is returned before the end of sale night.

 

Deposit is forfeited if the buyer:

  • wins a vehicle and fails to pay,

  • backs out of a sale,

  • refuses a vehicle after bidding,

  • misuses a bidder badge, or

  • violates auction rules.

BUYER’S FEE

Miller Auto Auction charges a 10% buyer’s fee, capped at a maximum of $300.

Examples:

  • $1,000 purchase → $100 fee

  • $2,000 purchase → $200 fee

  • $3,000 purchase → $300 fee

  • $4,000 purchase → $300 fee

  • $5,000 purchase → $300 fee

  • $10,000 purchase → $300 fee

No buyer will ever be charged more than $300, regardless of purchase price.

SELLER’S FEE

Miller Auto Auction charges a 10% seller’s fee, capped at a maximum of $300.

Examples:

  • $1,000 sale price → $100 seller fee

  • $2,000 sale price → $200 seller fee

  • $3,000 sale price → $300 seller fee

  • $4,000 sale price → $300 seller fee

  • $5,000 sale price → $300 seller fee

  • $10,000 sale price → $300 seller fee

No seller will ever be charged more than $300, regardless of sale amount. The seller’s fee is deducted from the seller’s proceeds at checkout.

NO WARRANTIES – AS‑IS SALES

All items are sold AS‑IS, WHERE‑IS, with no warranty expressed or implied.

  • Buyers have the opportunity to inspect all items before bidding.

  • OBD‑II scanners are welcome and encouraged.

  • Buyers may not claim adjustments, allowances, rescission, or damages after purchase.

  • All sales are final.

CATALOG & ADVERTISING ACCURACY

Descriptions, photos, and conditions listed in catalogs, brochures, or online postings are believed to be correct but are not guaranteed.

Miller Auto Auction does not guarantee:

  • year models,

  • mileage,

  • hours,

  • equipment condition, or

  • manufacturer warranties.

Meter readings reflect the reading at check‑in only. Buyers are responsible for verifying all information prior to bidding.

RISK OF LOSS

​Once the auctioneer announces “sold,” the buyer assumes full responsibility and risk of loss for the item. Buyer agrees to obtain liability insurance immediately.

LOADING

Miller Auto Auction staff may assist with loading, but are not responsible for:

  • damage during loading/unloading,

  • securing loads,

  • improper transport preparation.

Buyers are solely responsible for securing their own loads.

REMOVAL, STORAGE & ABANDONED ITEMS

All purchased items must be removed within five (5) business days of the auction.

After 5 days:

  • $25 per day storage fee per item applies

  • Storage fees continue up to 45 days

After 45 days:

  • Items are considered abandoned

  • Miller Auto Auction may resell the items

  • Storage fees continue until resale

Removal Hours: Monday–Friday, 9:00 AM – 5:00 PM (CST)

AUCTION SITE SAFETY

The auction yard contains heavy equipment, moving vehicles, chemicals, pressurized systems, electrical hazards, and other risks.

All attendees enter at their own risk. Buyers are responsible for warning their guests, employees, or representatives of potential hazards.

​

No person shall hold Miller Auto Auction, its owners, employees, or agents liable for injury, death, or property damage occurring on the premises.

NON-PAYMENT & COLLECTIONS

Failure to pay for any item may result in:

  • forfeiture of deposit,

  • permanent banning,

  • legal action,

  • referral to a licensed collection agency,

  • negative credit reporting.

Buyer is responsible for all legal fees, collection costs, and administrative expenses.

SURVEILLANCE & MEDIA CONSENT

By entering the property, buyers acknowledge and consent to:

  • video surveillance,

  • audio recording,

  • photography,

  • use of images or video for marketing, social media, or promotional purposes, including YouTube.

No compensation will be provided for such use.

BIDDER BADGE MISUSE

Bidder badges are assigned to one individual and are non‑transferable. Using another person’s badge or allowing someone to use yours will result in:

  • immediate forfeiture of deposit,

  • removal from the auction,

  • potential permanent ban.

TITLES

Titles are not guaranteed to be available on sale day. If not picked up in person, titles may be mailed via USPS Certified Mail.

No titles will be provided for:

  • trailers,

  • ATVs,

  • UTVs,

  • off‑road motorcycles, unless specifically announced by the auctioneer.

FINAL AGREEMENT

By registering and bidding, the buyer acknowledges and agrees to all terms listed above, all posted rules, and all announcements made on sale day.
